Terms of Engagement
Vigilant Risk Ltd trading as Vigilant Surveys · surveys@vigilantsurveys.co.uk · 07791 178 870
1. Who we are and how these terms apply
These terms of engagement form the contract between Vigilant Risk Ltd, trading as Vigilant Surveys (“we”, “us”), and the person or organisation instructing us (“you”). Booking an appointment, paying for a survey, or instructing us in writing constitutes acceptance of these terms.
2. The service
We provide independent damp, mould and compliance surveying: damp and mould surveys, focused damp investigations, Legionella risk assessments, housing condition (HHSRS) assessments, compliance health checks, tenancy changeover audits, and housing disrepair reports (CPR Part 35). We are independent of the outcome: we carry out no remedial work, sell no products, and take no commission or referral fee from anyone who carries out repairs, so our findings are never a sales pitch.
3. Scope and limitations
Surveys are visual, non-invasive inspections of the accessible areas of the property on the day of the visit, supported by moisture readings and, where included, thermal imaging. We cannot report on concealed, inaccessible or obstructed areas, and conditions can change after the inspection date. Our reports are not structural surveys, valuations or asbestos surveys, and should not be relied on as such.
4. Booking and access
Someone must be available to provide full access at the agreed appointment time, including all rooms, loft hatches, cellars and outbuildings where relevant. If we cannot gain entry within 25 minutes of arrival and cannot reach you, a call-out charge may apply and the survey will need to be rescheduled.
5. Cancellation and rescheduling
Appointments may be cancelled or rescheduled free of charge up to 48 hours before the survey. Cancellations within 48 hours incur a 50% charge. Same-day cancellations are charged in full.
6. Payment
After you enquire, we confirm your survey with you by phone or message. Payment is then made via a secure payment link and is due before the survey date, unless we have agreed otherwise in writing. Invoicing on 14-day terms is available to established business clients by prior written agreement. We may charge interest on late payments under the Late Payment of Commercial Debts (Interest) Act 1998.
7. Your report
Written reports are delivered by email within 24 hours of the survey. Reports are prepared for your sole use and benefit; no other person or organisation may rely on them without our prior written consent. We retain copyright in the report until payment has been received in full, after which you have a licence to use it for the purpose it was commissioned.
8. Liability
Our total liability arising from any one survey or report is limited to £1,000,000. We are not liable for indirect or consequential loss, including loss of rent, profit or opportunity. Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited.
9. Insurance
We hold professional indemnity insurance of £1,000,000 and public liability insurance of £5,000,000. Certificate details are available on request and are provided with booking confirmations for business clients.
10. Complaints
If you are unhappy with any aspect of our service, email surveys@vigilantsurveys.co.uk. We will acknowledge your complaint within two working days and aim to resolve it within fourteen days.
11. Data protection
We handle personal data in accordance with UK data protection law, use it only to deliver the service you have instructed, and do not share it with third parties except as needed to perform the work or as required by law.
12. Governing law
These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
